TOR ที่ผู้แทนรัฐบาลไทยและเมียนมาลงนามเมื่อ 6 ส.ค. ที่ผ่านมา ระหว่างการมาเยือนไทยอย่างเป็นทางการครั้งแรก ของ มิน ออง ไลง์ ประธานาธิบดีเมียนมา (6–7 ส.ค. 2569) นับตั้งแต่การรัฐประหารยึดอำนาจรัฐบาลที่มาจากการเลือกตั้งของนางออง ซาน ซู จี เมื่อปี 2564
TOR ที่ถูกคัดค้านต่อเนื่องจากหลายภาคส่วน ทั้งภาคการเมือง วิชาการ และภาคประชาสังคม ในหลายประเด็นสำคัญ โดยเฉพาะเงื่อนไขการเปิดเผยข้อมูลสู่สาธารณะ การมีส่วนร่วม ประสิทธิภาพการแก้ปัญหา และความเสี่ยงชุมชน ที่ถูกวิพากษ์วิจารณ์อย่างหนักว่า “รับไม่ได้ ส่อทำให้ไทยเสียประโยชน์ และแลกรับความเสี่ยงเพิ่ม”
ขอบเขตอำนาจหน้าที่ (TOR)
คณะทำงานร่วมด้านการจัดการคุณภาพน้ำในแม่น้ำที่เป็นพรมแดนและแม่น้ำที่ไหลผ่านระหว่างไทยและเมียนมา
(Terms of Reference (TOR) of Joint Working Group on Water Quality Management in Boundary and Transboundary Rivers between Thailand and Myanmar)
ความเป็นมา (Background)
รัฐบาลแห่งราชอาณาจักรไทยและรัฐบาลแห่งสาธารณรัฐแห่งสหภาพเมียนมา (ซึ่งต่อไปนี้จะเรียกว่า “ฝ่าย” ในกรณีที่กล่าวถึงฝ่ายหนึ่ง และ “ทั้งสองฝ่าย” ในกรณีที่กล่าวถึงทั้งสองฝ่ายร่วมกัน)
- ตระหนักถึงความสำคัญของแม่น้ำที่เป็นพรมแดนและแม่น้ำที่ไหลผ่านระหว่างไทยและเมียนมา ในฐานะแหล่งน้ำสำคัญที่หล่อเลี้ยงวิถีชีวิต ระบบนิเวศ การเกษตร การประมง และสุขภาวะของประชาชนในทั้งสองประเทศ
- รับทราบถึงความท้าทายจากการปนเปื้อนที่เพิ่มขึ้นและความเสื่อมโทรมของคุณภาพน้ำ อันเนื่องมาจากการขยายตัวของเมือง การพัฒนาอุตสาหกรรม การทำเหมืองแร่ น้ำชะหน้าดินจากการเกษตร และความผันผวนของสภาพภูมิอากาศ ฯลฯ
- คำนึงถึงพันธกรณีร่วมกันของทั้งสองฝ่ายภายใต้กรอบความร่วมมือระดับภูมิภาคและระดับระหว่างประเทศว่าด้วยการบริหารจัดการน้ำอย่างยั่งยืน รวมถึงกลไกความร่วมมือเกี่ยวกับแม่น้ำโขงและกรอบความร่วมมือของอาเซียน
- มีความประสงค์ที่จะกระชับความร่วมมือทวิภาคีในการรักษาคุณภาพน้ำและจัดการกับความเสี่ยงด้านสาธารณสุขของชุมชนที่อาศัยอยู่ริมฝั่งแม่น้ำ
จึงตัดสินใจจัดตั้งคณะทำงานร่วมว่าด้วยการบริหารจัดการคุณภาพน้ำในแม่น้ำที่เป็นพรมแดนและแม่น้ำที่ไหลผ่านระหว่างไทยและเมียนมา (ซึ่งต่อไปนี้จะเรียกว่า “คณะทำงานร่วม” หรือ “JWG”)
วัตถุประสงค์ (Purposes)
คณะทำงานร่วม (JWG) จะทำหน้าที่เป็นเวทีทวิภาคีเพื่อ:
- ประสานงานและดำเนินการเฝ้าระวังร่วมกันด้านคุณภาพน้ำในแม่น้ำที่เป็นพรมแดนและแม่น้ำที่ไหลผ่านระหว่างไทยและเมียนมา
- ตรวจสอบและระบุแหล่งที่มาของการปนเปื้อนและจุดวิกฤตปัญหามลพิษ
- จัดการกับข้อห่วงกังวลเกี่ยวกับผลกระทบต่อสาธารณสุขและการดำรงชีวิตในชุมชนริมฝั่ง
- อำนวยความสะดวกในการแบ่งปันข้อมูล การแจ้งเตือนล่วงหน้า การรายงานร่วมกัน และความร่วมมือทางวิชาการ
- สนับสนุนการพัฒนานโยบายและความร่วมมือในระดับภูมิภาคด้านการจัดการคุณภาพน้ำ
- ส่งเสริมโครงการสร้างความตระหนักรู้แก่สาธารณชนเกี่ยวกับความสำคัญของการจัดการที่ยั่งยืนและการคุ้มครองคุณภาพน้ำ ตลอดจนการมีส่วนร่วมกับองค์กรภาคประชาสังคมในท้องถิ่น
ขอบเขต (Scope)
คณะทำงานร่วม (JWG) จะดำเนินกิจกรรมต่าง ๆ ดังต่อไปนี้:
1. ติดตามตรวจสอบคุณภาพน้ำแบบประสานความร่วมมือ (Coordinated Monitoring of Water Quality)
จัดตั้งสถานีติดตามตรวจสอบที่มีมาตรฐานสอดคล้องกัน ใช้ระเบียบวิธีและตัวชี้วัดร่วมกัน ดำเนินการเก็บตัวอย่างและวิเคราะห์ทางห้องปฏิบัติการร่วมกันในพื้นที่และตามมาตรฐานที่ตกลงกันไว้ เพื่อเปรียบเทียบผลการวิเคราะห์คุณภาพน้ำของทั้งสองประเทศ และจัดทำรายงานการติดตามตรวจสอบร่วมประจำปี
2. การตรวจสอบแหล่งที่มา การระบุความเสี่ยง และการจัดตั้งระบบแจ้งเตือนล่วงหน้า (Source Investigation, Risk Identification, and Establishment of an Early Warning System)
ประสานงานการติดตามตรวจสอบคุณภาพน้ำในพื้นที่ที่ตกลงร่วมกันของแต่ละประเทศและแลกเปลี่ยนข้อมูลระหว่างกัน ประเมินแหล่งกำเนิดมลพิษและการปนเปื้อนที่อาจเกิดขึ้น ระบุพื้นที่ที่มีความเสี่ยงสูงหรือจุดวิกฤต (hotspots) รวมถึงพัฒนาระบบเตือนภัยล่วงหน้าร่วมกันเพื่อรองรับสถานการณ์มลพิษทางน้ำได้อย่างทันท่วงที
3. ข้อห่วงกังวลด้านสาธารณสุข (Public Health Concerns)
ประเมินความเสี่ยงทางสุขภาพที่เกี่ยวข้องกับโรคที่มากับน้ำและการสัมผัสโลหะหนัก ยกระดับการเฝ้าระวังและการสร้างความตระหนักรู้ในชุมชน รวมถึงจัดทำสื่อสำหรับการสื่อสารเรื่องความเสี่ยง
4. การเสริมสร้างศักยภาพและความร่วมมือทางวิชาการ (Capacity Building and Technical Cooperation)
จัดการประชุมเชิงปฏิบัติการร่วม โครงการฝึกอบรม และกิจกรรมแลกเปลี่ยนทางวิชาการ รวมถึงจัดทำแนวทางปฏิบัติสำหรับการติดตามตรวจสอบ การประกันคุณภาพข้อมูล และการตอบโต้ภาวะฉุกเฉิน
5. การประสานงานด้านนโยบายและยุทธศาสตร์ (Policy and Strategic Coordination)
ให้ข้อเสนอแนะแก่ทั้งสองฝ่ายเกี่ยวกับมาตรฐานและการจัดการคุณภาพน้ำ โดยร่วมมือกันภายใต้นโยบายและกรอบการดำเนินงานที่แต่ละประเทศกำหนดไว้
แนวทางการดำเนินงาน (Modality)
- คณะทำงานร่วม (JWG) จะมีประธานร่วมซึ่งเป็นเจ้าหน้าที่ระดับสูงที่ได้รับมอบหมายจากแต่ละฝ่ายที่เข้าร่วม
- จะมีการจัดการประชุมอย่างน้อยปีละ 2 ครั้ง โดยสลับกันจัดขึ้นระหว่างประเทศไทยและเมียนมา
- คณะทำงานร่วม (JWG) จะจัดทำแผนแม่บทระยะ 3 ปี และแผนการดำเนินงานประจำปี พร้อมทั้งรายงานความคืบหน้าต่อหน่วยงานที่เกี่ยวข้องของทั้งสองฝ่าย
- คณะทำงานร่วม (JWG) อาจเชิญผู้เชี่ยวชาญทางเทคนิคและผู้ทรงคุณวุฒิเข้าร่วมการดำเนินงาน ซึ่งรวมถึงบุคลากรจากสถาบันการศึกษาสถาบันวิจัย ชุมชนท้องถิ่น และหน่วยงานเฉพาะทางอื่น ๆ ตามที่ทั้งสองฝ่ายเห็นชอบร่วมกัน
- อาจมีการจัดตั้งคณะทำงานย่อยตามความจำเป็น เช่น คณะทำงานด้านการติดตามตรวจสอบ ด้านสาธารณสุข หรือด้านการสืบหาแหล่งกำเนิดปัญหา
องค์ประกอบ (Composition)
คณะทำงานร่วม (JWG) จะประกอบด้วยผู้แทนจาก:
ฝ่ายไทย
- กระทรวงทรัพยากรธรรมชาติและสิ่งแวดล้อม (ทส.)
- กรมควบคุมมลพิษ (คพ.)
- สำนักงานทรัพยากรน้ำแห่งชาติ (สทนช.)
- กรมอนามัย
- หน่วยงานราชการส่วนภูมิภาคจังหวัดเชียงราย
- หน่วยงานราชการส่วนภูมิภาคจังหวัดเชียงใหม่
- หน่วยงานราชการส่วนภูมิภาคจังหวัดแม่ฮ่องสอน
ฝ่ายเมียนมา
- กระทรวงทรัพยากรธรรมชาติและการอนุรักษ์สิ่งแวดล้อม (MONREC)
- กระทรวงสาธารณสุข
- กระทรวงคมนาคม
- กระทรวงมหาดไทย
- กรมป่าไม้
- กรมการเหมืองแร่
- สำนักบริหารจัดการทรัพยากรน้ำและการปรับปรุงระบบแม่น้ำ
- กรมอนุรักษ์สิ่งแวดล้อม
- รัฐบาลแห่งรัฐฉาน
อาจมีการเชิญผู้สังเกตการณ์จากสถาบันการศึกษา ชุมชนท้องถิ่น จากทั้งสองประเทศ โดยเป็นการดำเนินการร่วมกันตามที่ผู้เข้าร่วมกำหนด
การจัดสรรงบประมาณ (Financial Arrangement)
ผู้เข้าร่วมแต่ละฝ่ายจะรับผิดชอบค่าใช้จ่ายของตนเองสำหรับการเข้าร่วมในคณะทำงานร่วม (JWG) และกิจกรรมที่เกี่ยวข้องภายใต้ขอบเขตอำนาจหน้าที่ (TOR) นี้
การดำเนินการด้านการเงินจะต้องเป็นไปตามประมาณการงบประมาณที่กำหนดผ่านการหารือทวิภาคีและบรรจุไว้ในแผนการดำเนินงานประจำปีของแต่ละฝ่ายอย่างเคร่งครัด
ทั้งนี้ ฝ่ายต่าง ๆ ที่เกี่ยวข้องจะจัดหาอุปกรณ์วัดคุณภาพน้ำ ความช่วยเหลือทางวิชาการ และเงินทุนที่จำเป็นตามมติที่เห็นชอบร่วมกัน
ฝ่ายเลขานุการ (Secretariat Support)
การสนับสนุนด้านงานเลขานุการจะดำเนินการร่วมกันโดยหน่วยงานหลักที่ได้รับมอบหมายของทั้งสองฝ่าย ดังนี้:
ฝ่ายไทย: กรมควบคุมมลพิษ (คพ.)
ฝ่ายเมียนมา: กรมอนุรักษ์สิ่งแวดล้อม (ECD)
ฝ่ายเลขานุการจะทำหน้าที่ประสานงานการประชุม จัดเตรียมเอกสาร และอำนวยความสะดวกในการสื่อสารระหว่างทั้งสองฝ่าย
การรักษาความลับ (Confidentiality)
ทั้งสองฝ่ายจะรักษาความลับของข้อมูล ข้อมูลดิบ และเอกสารทั้งหมดที่มีการแลกเปลี่ยน หรือที่เกิดขึ้นหรือจัดทำขึ้นภายใต้ขอบเขตอำนาจหน้าที่ (TOR) นี้
ข้อมูลดังกล่าวจะไม่ถูกเปิดเผยหรือถ่ายโอนไปยังบุคคลภายนอก เว้นแต่จะได้รับความเห็นชอบร่วมกันเป็นลายลักษณ์อักษรจากคู่สัญญาทั้งสองฝ่าย
การเปิดเผยข้อมูลแก่หน่วยงานภายนอกจะกระทำได้ก็ต่อเมื่อได้รับความยินยอมเป็นลายลักษณ์อักษรล่วงหน้าจากคู่สัญญาทั้งสองฝ่ายแล้วเท่านั้น
การสื่อสารต่อสาธารณะ (Public Communication)
เอกสารข่าว แถลงการณ์ต่อสาธารณะ หรือสื่อประชาสัมพันธ์ใด ๆ ที่เกี่ยวข้องกับกิจกรรมภายใต้ขอบเขตอำนาจหน้าที่ (TOR) นี้ จะต้องผ่านการตรวจสอบและได้รับความเห็นชอบเป็นลายลักษณ์อักษรจากผู้เข้าร่วมทั้งสองฝ่ายก่อนที่จะมีการเผยแพร่หรือแจกจ่าย
การระงับข้อพิพาท (Resolution of Differences)
ข้อแตกต่างใด ๆ ที่เกิดขึ้นจากการปฏิบัติตามขอบเขตอำนาจหน้าที่ (TOR) นี้ จะได้รับการแก้ไขโดยสันติวิธีผ่านการหารือหรือการเจรจาระหว่างทั้งสองฝ่าย
การแก้ไขเพิ่มเติม (Amendment)
ขอบเขตอำนาจหน้าที่ (TOR) นี้ อาจได้รับการแก้ไขหรือเปลี่ยนแปลงได้ตามที่ทั้งสองฝ่ายตกลงร่วมกันเป็นลายลักษณ์อักษร
การแก้ไขหรือเปลี่ยนแปลงดังกล่าวจะถือเป็นส่วนหนึ่งของขอบเขตอำนาจหน้าที่ (TOR) นี้โดยสมบูรณ์ และจะมีผลบังคับใช้ในวันที่ทั้งสองฝ่ายกำหนดร่วมกัน
สถานะทางกฎหมาย (Legal Nature)
ขอบเขตอำนาจหน้าที่ (TOR) นี้ มีวัตถุประสงค์เพื่อใช้เป็นกรอบการดำเนินงานและการบริหารจัดการสำหรับความร่วมมือระหว่างผู้เข้าร่วม โดยไม่ก่อให้เกิดสิทธิหรือภาระผูกพันที่มีผลผูกพันทางกฎหมายภายใต้กฎหมายระหว่างประเทศหรือกฎหมายภายในประเทศแต่อย่างใด
การมีผลบังคับใช้และการสิ้นสุด (Effectiveness and Termination)
ขอบเขตอำนาจหน้าที่ (TOR) นี้ จะมีผลบังคับใช้นับแต่วันที่ลงนามเป็นระยะเวลา 3 ปี โดยทั้งสองฝ่ายอาจตกลงร่วมกันเพื่อขยายขอบเขตอำนาจหน้าที่ (TOR) นี้ได้
ทั้งนี้ ฝ่ายใดฝ่ายหนึ่งสามารถบอกเลิกขอบเขตอำนาจหน้าที่ (TOR) นี้ได้ตลอดเวลา โดยแจ้งความประสงค์เป็นลายลักษณ์อักษรให้คู่สัญญาอีกฝ่ายหนึ่งทราบล่วงหน้าเป็นเวลา 30 วัน
การบอกเลิกขอบเขตอำนาจหน้าที่ (TOR) นี้ จะไม่ส่งผลกระทบต่อความสมบูรณ์หรือความคืบหน้าของงานที่ได้ดำเนินการไปแล้วก่อนหน้านี้ โดยกิจกรรมที่อยู่ระหว่างดำเนินการจะต้องได้รับการสรุปผลอย่างเป็นระบบภายในระยะเวลา 90 วัน นับจากวันที่บอกเลิกขอบเขตอำนาจหน้าที่ (TOR) นี้
อย่างไรก็ตาม การดำเนินกิจกรรมต่อเนื่องดังกล่าวจะต้องไม่เกินกรอบระยะเวลาสูงสุด 3 ปี ของข้อกำหนดและเงื่อนไขฉบับนี้ และฝ่ายใดฝ่ายหนึ่งจะไม่ต้องรับภาระผูกพันหรือจัดสรรทรัพยากรเพิ่มเติมใด ๆ อีกภายหลังจากระยะเวลาดังกล่าว
การลงนาม
ขอบเขตอำนาจหน้าที่ (TOR) นี้ จัดทำขึ้นเป็นสองฉบับโดยมีข้อความถูกต้องตรงกัน ทั้งสองฝ่ายได้อ่านและทำความเข้าใจเนื้อหาทั้งหมดของขอบเขตอำนาจหน้าที่ (TOR) นี้แล้ว และเห็นว่าถูกต้องตรงตามเจตนารมณ์ของตน จึงได้ลงนามและประทับตรา (ถ้ามี) ไว้ต่อหน้าพยาน
คู่สัญญาแต่ละฝ่ายต่างเก็บรักษาต้นฉบับไว้ฝ่ายละหนึ่งฉบับเพื่อเป็นหลักฐาน
ในนามของสำนักงานปลัดกระทรวงทรัพยากรธรรมชาติและการอนุรักษ์สิ่งแวดล้อม

Terms of Reference (TOR) of Joint Working Group on Water Quality Management in Boundary and Transboundary Rivers between Thailand and Myanmar
Background
The Governments of the Kingdom of Thailand and the Republic of the Union of Myanmar (hereinafter referred to singularly as “the Participant” and collectively as “the Participants”),
- Recognizing the importance of boundary and transboundary rivers between Thailand and Myanmar as critical water resources that sustain livelihoods, ecosystems, agriculture, fisheries, and public health in both countries;
- Acknowledging the challenges of increasing contamination and water quality degradation arising from urbanization, industrial development, mining, agricultural runoff, and climate variability, and etc.;
- Recalling mutual commitments of the Participant under regional and international frameworks for sustainable water management, including the Mekong River cooperation mechanisms and ASEAN frameworks;
- Desiring to strengthen bilateral cooperation in safeguarding water quality and addressing public health risks for riparian communities;
Decide to establish a Joint Working Group on Water Quality Management in Boundary and Transboundary Rivers between Myanmar and Thailand (hereinafter referred to as the JWG).
Purposes
The JWG will serve as a bilateral platform to:
- Coordinate and implement joint monitoring of water quality in boundary and transboundary rivers between Thailand and Myanmar;
- Investigate and identify sources of contamination and pollution hotspots;
- Address concerns regarding impacts on public health and livelihoods in riparian communities;
- Facilitate data sharing, early warning, joint reporting, and technical cooperation;
- Support policy development and regional cooperation on water quality management.
- Promoting public awareness programs on the importance of sustainable management and water quality protection, and engagement with local civil society organizations.
Scope
The JWG will carry out the following activities:
Coordinated Monitoring of Water Quality
Establish harmonized monitoring stations, adopt common methodologies and parameters, conduct coordinated sampling and laboratory analysis, at mutually agreed locations with the mutually agreed standard for the comparative study of water quality laboratory findings between both countries and prepare annual joint monitoring reports.
Source Investigation, Risk Identification, and Establishment of an Early Warning System
Coordinating monitoring of water quality at mutually agreed locations of respective countries and exchanging the resulting data between both participants, assess potential contamination and pollution sources, identify high-risk areas or hotspots, including the development of joint early warning system for timely response to water pollution incidents.
Public Health Concerns
Assess health risks related to waterborne diseases and heavy metal exposure, enhance surveillance and community awareness, and develop risk communication materials.
Capacity Building and Technical Cooperation
Organize joint workshops, training programs, technical exchanges, and develop guidelines for monitoring, data assurance, and emergency response.
Policy and Strategic Coordination
Provide recommendations to both Participants on water quality standards and management, cooperating in accordance with the respective policies and frameworks established by each country.
Modality
- The JWG will be co-chaired by senior officials designated by each Participant.
- Meetings will be convened at least twice annually, alternating between Thailand and Myanmar.
- The JWG will prepare Three years master plan and annual work plan, and submit progress reports to the respective authorities of both Participants.
- The JWG may engage technical experts and resource persons, including from academic and research institutions, local communities, and other specialized bodies, as jointly decided by the Participants.
- Sub working groups may be established as required, for example on monitoring, public health, or source investigation.
Composition
The JWG will consist of representatives from:
Thailand:
- Ministry of Natural Resources and Environment (MONRE).
- Pollution Control Department (PCD).
- Office of the National Water Resources (ONWR).
- Department of Health.
- Chiang Rai Provincial Authorities.
- Chiang Mai Province Authorities.
- Mae Hong Son Province Authorities.
Myanmar:
- Ministry of Natural Resources and Environmental Conservation (MONREC).
- Ministry of Health.
- Ministry of Transport,
- Ministry of Home Affairs,
- Forest Department,
- Department of Mines,
- Directorate of Water Resources and Improvement of River Systems,
- Environmental Conservation Department,
- Shan State Government.
Observers from academic institutions, local communities, may be invited as jointly from both countries decided by the Participants.
Financial Arrangement
Each Participant will bear its own costs for participation in the JWG and related activities under this TOR.
Financial implementation shall be carried out strictly according to the budget estimates established through bilateral discussions and integrated into the respective Annual Work Plans.
The parties involved shall provide water quality measurement devices, technical assistance, and necessary funding based on joint resolutions.
Secretariat Support
Secretariat support will be jointly provided by the designated lead agencies of both Participant:
- Thailand: Pollution Control Department (PCD)
- Myanmar: Environmental Conservation Department (ECD)
The Secretariat will coordinate meetings, prepare documentation, and facilitate communication between the Participants.
Confidentiality
Both Participants will maintain the confidentiality of all information, data, and documents exchanged or generated or created under this TOR.
Such information will not be disclosed or transferred to any third party unless jointly decided in writing by both Participants.
Any disclosure to external entities will be made only upon prior written consent of both Participants.
Public Communication
Any press release, public statement, or promotional material related to the activities carried out under this TOR will be subject to prior review and written approval by both Participants before publication or dissemination.
Resolution of Differences
Any differences arising out of the implementation of this TOR will be resolved amicably through consultation or negotiation between the Participants.
Amendment
This TOR may be amended or modified as jointly decided in writing by both Participants.
Such modification or amendment so will constitute an integral part of this TOR and will come into effect on the date mutually determined by the Participants.
Legal Nature
This TOR is intended to serve as an operational and administrative framework for cooperation between the Participants.
It does not create any legally binding rights or obligations under International or domestic law.
Effectiveness and Termination
This TOR will come into effect on the date of its signature for a period of (3) years.
The Participants may renew this TOR by joint decision.
Any Participant may terminate this TOR at any time by giving the other Participant 30 days’ written notice of its intention.
The termination of this TOR will not affect the validity or progress of any work previously carried out.
Ongoing activities shall only be systematically concluded within 90 days before the date of termination.
However, continuation of activities shall not extend beyond the maximum 3 years duration of this TOR, and no further resource allocation or liability shall be incurred by either Participant thereafter.
Execution
This TOR is made in duplicate with identical wording.
